1. Information About Our Company and the Official Merchant (Merchant of Record):Your contract for the purchase of products is entered into with U.S. Direct E-Commerce Limited, trading as ESW, a company registered in Ireland (company number 479237), whose registered office is located at South Block, The Concourse Building, 110-115 Airside Business Park, Swords, County Dublin, Ireland.ESW is the designated Merchant of Record. By placing an order, you acknowledge that your transaction is with ESW and not with the respective retailer (Chantelle). ESW purchases the merchandise from the retailer for the sole purpose of immediately reselling it to you. In the event of any discrepancy between the terms of this document in another language and the English version, the English version shall prevail.
2. Order Processing and Payment:Your credit/debit card or any other payment method will be charged by ESW immediately after the order is placed. The charges on your statement will appear as "ESW", "eSW", or similar.ESW will perform pre-payment screening to prevent any transactions with sanctioned persons, entities, or countries in violation of applicable laws and regulatory requirements (including customs laws and export/import controls).Payment for purchases is made by bank card/payment method:

3. Transfer of Ownership, Risks, and Customs Authorization:Title to the products transfers from the retailer to ESW upon export. Title then transfers from ESW to you prior to import, and you will be the importer of record, except for deliveries to Switzerland, where ESW will be the importer of record.The risk of loss transfers to you upon delivery of the products.By ordering products, you authorize a licensed customs broker chosen by ESW to act on your behalf to carry out customs clearance operations with foreign tax authorities, declare duties and taxes, and prepare and submit refund claims on your behalf for any returned merchandise.
4. Pricing, Taxes, and Customs Duties:
- For the European Union (Czech Republic, Denmark, Finland, Ireland, Latvia, Lithuania, Netherlands, Poland, Portugal) and the United Kingdom: The resulting taxes and customs duties are included in your payment and are settled by ESW; there are no additional costs.
- For Europe in general (including Switzerland and Norway): The price of your order will be indicated inclusive of all taxes (including VAT).
- For China and Hong Kong (imports outside Europe): You will be responsible for paying taxes and customs duties to the competent tax authority.
- For Australia: By placing an order, you acknowledge that you are making an international transaction. Some banks may charge international transaction fees in accordance with their policies. We do not charge these fees and do not control when your bank will apply them.

5. Standard Returns and Defective Merchandise:

Right of Withdrawal (Specific to European Union Consumers):If you are a consumer habitually residing in the European Union, you have the right to withdraw from this contract within fourteen (14) days without giving any reason.The withdrawal period expires fourteen (14) days after the date on which you (or a third party designated by you) take physical possession of the goods.To exercise this right, you must inform ESW (email: info@eshopworld.com) of your decision. 7. Returns of Dangerous Goods (Perfumes and Fragrances) (if applicable):
- For the United Kingdom: If you wish to return fragrances, all shipping and handling fees are prepaid and no subsequent payment will be your responsibility. The goods must be fully resalable, unopened, and unused.
- For the European Union: ESW will provide an online return label, but you will have to pay all shipping and handling fees from your address to ESW's return address.
8. Applicable Law and Dispute Resolution:
13. Legal Warranties (French Consumer Code & Civil Code)13.1 Under the statutory warranty of conformity, the Buyer has the following guarantees:Article L211-4 of the Consumer Code:
The seller is required to deliver goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions, or installation when the latter was made their responsibility by the contract or carried out under their responsibility.Article L211-5 of the Consumer Code:
To conform to the contract, the goods must:Article L211.7 of the Consumer Code:
- Be fit for the purpose usually expected of similar goods and, where applicable:
- correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model;
- present the qualities that a buyer can legitimately expect given the public statements made by the seller, the producer, or their representative, particularly in advertising or labeling;
- Or present the characteristics defined by mutual agreement between the parties or be fit for any special use sought by the buyer, brought to the seller's attention and accepted by the latter.
Any lack of conformity appearing within twenty-four months from the delivery of the goods is presumed to exist at the time of delivery, unless proven otherwise. The seller may challenge this presumption if it is incompatible with the nature of the goods or the alleged lack of conformity.Article L211.10 of the Consumer Code:
If repair and replacement of the goods are impossible, the buyer may return the goods and have the price refunded. The same option is available to them:Article L211-12 of the Consumer Code:
- If the solution requested, proposed, or agreed upon pursuant to Article L.211-9 cannot be implemented within one month following the buyer's complaint;
- Or if this solution cannot be implemented without major inconvenience to the buyer, given the nature of the goods and the use they seek. However, rescission of the sale cannot be pronounced if the lack of conformity is minor.
Action resulting from a lack of conformity is time-barred after two years from the delivery of the goods.
13.2 Under the statutory warranty against hidden defects, the Buyer has the following guarantees:Article 1641 of the Civil Code:
The seller is bound by the warranty against hidden defects in the thing sold which render it unfit for the use for which it is intended, or which so diminish this use that the buyer would not have acquired it, or would only have given a lower price, if they had known about them.Article 1645 of the Civil Code:
If the seller was aware of the defects of the thing, they are bound, in addition to restoring the price received, for all damages towards the buyer.Article 1646 of the Civil Code:
If the seller was unaware of the defects of the thing, they shall only be bound to restore the price and to reimburse the buyer for the expenses occasioned by the sale.Article 1648 paragraph 1 of the Civil Code:
Action resulting from redhibitory defects must be brought by the buyer within two (2) years from the discovery of the defect.
Article 14: Limitation of LiabilityChantelle cannot be held liable for the non-performance of the contract due to a case of force majeure, or due to the consumer, or due to the unpredictable and insurmountable act of a third party to the contract.Chantelle cannot be held liable for any indirect damage resulting from the purchase of products on the site. Chantelle declines all liability for any interruption of the site, for any occurrence of bugs, for any damage resulting from a fraudulent intrusion by a third party leading to a modification of the information made available on the site, for non-substantial errors relating to the products, or for the inability to reach the WEB Customer Service and/or access the site.https://chantelle.com/shop/en-ie cannot be held liable, to a member or a third party, for any indirect damage, loss of business, profit, or turnover, arising in any manner whatsoever, even if such damage, loss, or injury was foreseeable by https://chantelle.com/shop/en-ie, or if its possibility had been brought to its attention.
Article 16: Intellectual Property:All texts, comments, works, illustrations, and images reproduced on the Site are protected under copyright, trademark law, patent law, and image rights, for all media and worldwide.They are the full and complete property of Chantelle. As such, and in accordance with the provisions of the Intellectual Property Code, only use for private and non-commercial purposes is authorized, subject to different or even more restrictive provisions of the Intellectual Property Code. Any other use constitutes infringement and is punishable under intellectual property law unless prior authorization is granted by the Site. Any total or partial reproduction of the Site's catalog is strictly prohibited.
Article 17: Applicable Law – Disputes:These General Terms and Conditions of Sale are subject to French law and its interpretation. Any dispute relating to their interpretation or execution shall be submitted to the competent courts.
Article 18: Personal Information:Chantelle undertakes not to disclose to third parties the information communicated by Buyers on the Site. This information is confidential. It will only be used by its internal services for processing the order and to strengthen and personalize communication, notably through newsletters / information emails, as well as within the framework of personalizing the Site according to the user's observed preferences.
